CLASS ACTIONS

By Order of the Ontario Superior Court of Justice, all person and entities who appointed Gukathasan to act as power of attorney in respect of the sale of their DSC shares acquired by Entegris are advised that:

A class action proceeding was commenced in February 2022 on behalf of those persons and entities who appointed Gukathasan to act as power of attorney in respect of the sale of their shares of DSC acquired by Entegris. The Plaintiff in the class action alleged negligence and breach of fiduciary duty on the part of the Defendants.

The Defendants deny these allegations.

You are receiving this notice because you previously inquired with Stienburg Law and Bobila Walker Law LLP (collectively, “Plaintiff’s counsel“) in respect of this class action.

Plaintiff’s counsel are of the opinion that the proposed class action is no longer viable and the representative plaintiff no longer wishes to pursue the class action. On this basis, Plaintiff’s counsel sought and obtained the approval of the Ontario Superior Court of Justice to discontinue this class action proceeding

YOU SHOULD TAKE NOTICE that the limitation for bringing a claim, if there is any time left within it, will recommence on February 7, 2023. On the expiry of the limitation period, your right to sue may be extinguished. Limitation periods vary across Canada. As such, you should seek legal advice from local counsel. If you wish to pursue a court claim, you should issue a Notice of Action or Statement of Claim (or equivalent document in your province) before the applicable limitation period expires. You should contact your own lawyer about this.
